Bizarre incident leads to federal prosecutor being charged with a felony sex crime at downtown bar

A bizarre case out of downtown has led to the arrest of a federal prosecutor on a felony sex charge in Miami after he went swimming in his boxer shorts at a hotel swimming pool, the Miami Herald reported.

The 35-year-old defendant, a Boston native, was watching the New England Patriots on a big-screen television at an outdoor bar overlooking the Miami River and downtown. He went for a swim in the hotel pool wearing only his boxer shorts and was allegedly exposed when he climbed out of the water. A girl and her mother were in the pool at the time and witnessed the incident.

As a result, he has been arrested and charged with lewd and lascivious behavior in front of a minor under 16 — a felony. The defendant allegedly tried to leave through a rear exit as staff tried to keep him detained until police arrived. He was stopped and arrested about 2:30 p.m. He was also charged with resisting arrest without violence.

There is no word on whether he was intoxicated at the time. His lawyer called the charges “beyond absurd.” He said his client went swimming in his boxer shorts, paid his tab and left the outdoor bar. The state attorney’s office said it was determining whether or not to file charges.

The U.S. Attorney’s Office in Miami, where the defendant works in the appellate division, declined to comment. He was reprimanded last year when he and other prosecutors were accused of mishandling evidence in a prescription drug case involving a Miami Beach physician.
